Bill Summary

This bill relates to disputed land boundaries and corners. Under current law, Code section 650.14 provides that boundaries and corners recognized and acquiesced in for a period of 10 years shall be permanently established boundaries and corners. The bill provides that boundaries and corners are permanently established by acquiescence through self-execution of Code section 650.14. The bill provides that common ownership of adjacent tracts where acquiesced boundaries and corners have been permanently established does not terminate the acquiesced boundary and corners previously established through self-execution. Under the bill, adjoining parties may subsequently recognize and acquiesce to new boundaries and corners and if subsequently recognized and acquiesced in for a period of 10 years those boundaries and corners become permanently established.

AI Summary

This bill modifies existing Iowa law regarding land boundaries and property lines, specifically addressing how boundaries are established through a legal concept called "acquiescence." Currently, if neighboring property owners have recognized and accepted a particular boundary line for 10 consecutive years, that boundary becomes permanently established. The bill clarifies that this process is "self-executing," meaning it happens automatically when the 10-year period is met. An important new provision specifies that if the adjacent properties are later owned by the same person, this does not invalidate the previously established boundary line. Additionally, the bill allows for future boundary changes, stating that if adjoining property owners subsequently recognize and agree to a different boundary line and maintain that agreement for 10 years, the new boundary can then become permanently established. This provides more clarity and flexibility for property owners in resolving land boundary disputes and recognizing long-standing informal property line agreements.
