AI Summary

This bill introduces strict measures regarding public benefits and legal status for immigrants in Kansas. It prohibits individuals who are unlawfully present in the United States from receiving state or local public benefits, with limited exceptions. The legislation requires all applicants aged 18 and older to provide documentary proof of citizenship, permanent residency, or lawful presence when applying for public benefits, using verification methods like the systematic alien verification for entitlements program operated by the Department of Homeland Security. The bill also modifies criminal bail procedures by mandating immigration status verification for non-citizen defendants and creating a rebuttable presumption that unlawfully present aliens pose a flight risk. Additionally, the bill specifically addresses postsecondary education, stating that undocumented immigrants cannot receive reduced tuition or fee amounts at educational institutions. The legislation includes a severability clause, meaning that if any part of the act is found unconstitutional, the remaining provisions will remain in effect, and it is set to take effect upon publication in the state statute book.
