This bill modifies existing law to give parents more choice in selecting nursing services for children with disabilities under their Individualized Education Program (IEP). Specifically, the bill allows parents to choose a nurse who has previously provided care to their child, either before the IEP was established or before the child enrolled in their current school, provided certain conditions are met. These conditions include that the chosen nurse is employed by a nursing agency willing to work with the local educational agency, the agency is willing to enter into a standard contract meeting typical licensing and liability requirements, and the contracted rate is comparable to or lower than other nurses contracted by the agency. The bill defines nursing services as those that can only be provided by nurses licensed under North Carolina law, and explicitly states that this provision does not limit the local educational agency's responsibility to provide a free appropriate public education. The changes will take effect for the 2025-2026 school year, giving parents more flexibility in selecting nursing support for their children with special needs.
