This bill amends the Idaho Administrative Procedure Act to modify the process for reviewing and sunsetting administrative rules. Under the revised law, each administrative rule chapter will be subject to a staggered sunset review between July 1, 2026, and June 30, 2034, with similar reviews occurring every eight years thereafter. The administrative rules coordinator will establish and publish the sunset schedule by January 1, 2026. When an agency intends to renew a rule chapter, it must now prepare a more comprehensive statement for the legislature that includes the statute or federal regulation the rule implements, justification for the rule's continued necessity, evidence of its benefits relative to its costs, and an assessment of whether the rule's content would be better integrated directly into Idaho Code. The agency must also consider factors such as the benefit of consolidating related requirements, the frequency of rule updates, publication costs, and the expected enforcement costs. The bill declares an emergency and will take effect on July 1, 2025, signaling the importance of updating the administrative rule review process.
