This bill modifies Texas health care facility billing regulations by requiring facilities to provide patients with a written estimate for nonemergency elective medical services prior to scheduling, which must be delivered within 24 hours of the patient's request through their preferred method (in person, email, or online patient portal). The estimate must outline the total amount the facility will accept as full payment, including all payment sources. The bill also stipulates that final billed charges cannot exceed the estimated amount by more than 5% unless specific medical complications or diagnostic changes occur, and if they do, the facility must provide a written explanation detailing the reasons for the increase. Additionally, if a facility fails to comply with these requirements, they are prohibited from collecting payment, reporting the patient to credit bureaus, or pursuing legal action against the patient, and may be subject to enforcement action by the appropriate licensing agency. The changes will apply to estimate requests made on or after the bill's effective date of September 1, 2025, and are designed to increase transparency and protect patients from unexpected medical billing surprises.
