This bill modifies Texas state law regarding cemetery establishment restrictions by removing specific subsections (g-3) and (g-4) from Section 711.008 of the Health and Safety Code. The existing law currently prohibits individuals, corporations, partnerships, firms, trusts, or associations from establishing or operating cemeteries within certain distances from municipalities based on population size. For example, the law restricts cemetery establishment within one mile of municipalities with 5,000 to 25,000 people, within two miles of municipalities with 25,000 to 50,000 people, and so on, with increasing distance restrictions for larger population centers. By repealing subsections (g-3) and (g-4), the bill appears to be simplifying or streamlining the existing cemetery establishment regulations. The bill is set to take effect on September 1, 2025, which provides ample time for local governments and potential cemetery operators to understand and adapt to the changes in the law.
