This bill adds a new section to the Idaho Administrative Procedure Act that establishes a time limit for state agencies' rulemaking authority. Specifically, for any statute passed on or after July 1, 2025, agencies will have ten years to develop all necessary rules and regulations related to that statute. After this ten-year period, agencies can only create new rules if the legislature makes a substantive amendment to the relevant section or chapter, or adds a new statute that grants rulemaking authority. In such cases, the agency must initiate the rulemaking process within two years of the amendment or new statute. This provision aims to ensure that agencies regularly review and update their rules, prevent outdated or unnecessary regulations from remaining in place indefinitely, and maintain legislative oversight of agency rulemaking. The bill will take effect immediately on July 1, 2025, as declared by an emergency clause.
