This bill amends South Carolina law by creating a new legal provision that allows unemancipated minors and their parents or legal guardians to sue for damages related to the loss of companionship, aid, society, and services caused by an intentional or tortious (wrongful) act. Specifically, an unemancipated minor (a child who has not legally become independent from their parents) can file a lawsuit seeking damages for the violation of their right to parental companionship and support, but cannot recover damages that have already been recovered by their injured parent. Similarly, a parent or legal guardian can sue for damages related to the loss of their child's companionship and services, but cannot recover damages that have already been obtained by the child. The bill will take effect immediately upon the Governor's approval, creating a new legal pathway for families to seek compensation for significant disruptions to their familial relationships caused by tortious actions.
