AI Summary

This bill, known as the "Georgia High School NIL Protection Act," allows high school student athletes in Georgia to earn compensation for the use of their name, image, or likeness (NIL), which refers to payments received for allowing others to use their identity. It clarifies that this compensation cannot be tied to attending a specific school or postsecondary educational institution, and schools or their associated entities cannot provide NIL compensation. Student athletes are prohibited from using school identification or mentioning their school or athletic association when engaging in NIL activities, and they cannot endorse certain products or services deemed harmful or inappropriate, such as alcohol, tobacco, or weapons, during interscholastic athletic activities, though exceptions exist for practices and training. Schools must inform student athletes in writing about the provisions of this act and how NIL compensation might affect their future eligibility for college athletics. Contracts for NIL compensation will automatically expire shortly after a student athlete graduates or their enrollment at the school ends, and athletic associations are prevented from penalizing students or schools for NIL compensation. The bill also allows student athletes to obtain professional representation, such as from athlete agents or lawyers, and amends existing laws regarding the employment of minors to include compensation for the use of a minor's name, image, or likeness, with the Commissioner of Labor's consent required after ensuring the work environment and compensation are not detrimental to the minor's health or education, and that their name, image, or likeness will not be used for prohibited purposes.
