This bill modifies state finance law and public authorities law to require state departments, agencies, and authorities to prioritize purchasing personal protective equipment (PPE) and medical supplies produced or manufactured in New York State. For contracts over $50,000, these entities must now ensure that PPE and medical supplies are primarily produced in New York and must utilize preferred sources for at least 30% of these items. The bill provides exceptions where the head of the department or authority can waive these requirements if they determine that: the provisions are not in the public interest, obtaining New York-produced items would unreasonably increase contract costs, the items cannot be produced in New York in sufficient quantities or quality, or purchasing outside of New York is necessary to avoid delays in critical services. If a New York state source or preferred source cannot supply the items, the bill allows for purchasing PPE or medical supplies produced substantially in the United States. The changes will apply to state contracting opportunities advertised 60 days after the bill becomes law, excluding contracts for which solicitations were already issued prior to the law's effectiveness.
