Bill Summary

AN ACT to amend the education law, in relation to contract cost adjustments in the middle of contract terms for school districts transportation contracts

AI Summary

This bill amends the New York Education Law to modify how school district transportation contracts can be adjusted mid-term. Specifically, the bill allows contract amendments for transportation services to include additional costs only in two narrow circumstances: first, if the amendment is necessary to comply with the statewide transition to zero-emission buses (a state initiative to replace traditional school buses with electric or other zero-emission vehicles), and second, only if the contractor can demonstrate an equivalent increase in their operational costs. The existing law already permitted contract amendments for compliance with new laws or to enhance pupil safety, but this amendment adds a specific provision for zero-emission bus transitions. The bill ensures that such amendments cannot circumvent competitive bidding requirements and must still be approved by the commissioner of education. The goal appears to be providing some flexibility for school districts and transportation contractors to adapt to new environmental regulations while maintaining fiscal responsibility and preventing unnecessary cost increases.
