This bill establishes a comprehensive regulatory framework for body piercing in North Carolina by requiring practitioners to obtain an annual permit from the Department of Health. The bill defines body piercing as piercing any part of a person's body (except ears) for the purpose of inserting jewelry, and requires that all body piercing establishments obtain a permit by applying to the local health department, which will inspect the premises, instruments, utensils, equipment, and procedures to ensure compliance with health standards. The Commission for Public Health will be responsible for creating specific rules about permit requirements, including sanitation standards. Notably, licensed physicians, physician assistants, and nurse practitioners working under a physician's supervision are exempt from these permit requirements. The Department of Health can deny, suspend, or revoke permits if an establishment does not meet the established standards, and any disputes will be governed by the Administrative Procedure Act. Importantly, obtaining a permit does not prevent potential prosecution for other legal violations related to body piercing. The bill will become effective on the date that the Commission for Public Health finalizes its implementing rules.
