This bill clarifies and protects student-athletes' rights to participate in non-school competitive activities without facing restrictions from their school or the West Virginia Secondary School Activities Commission (WVSSAC). The legislation establishes three key findings: first, that student-athletes should not be prevented from pursuing additional opportunities to develop and showcase their athletic skills simply because they are part of a school sports team; second, that prohibiting participation in non-school events as a condition of school team membership is arbitrary and not serving a legitimate state purpose; and third, that county boards of education and the WVSSAC are explicitly prohibited from restricting or preventing students from competing in non-school events or joining non-school competitive teams as a condition of participating in school-sponsored extracurricular sports. The bill aims to expand athletic opportunities for students by removing barriers that might prevent them from gaining additional competitive experience outside of their school's sports programs.
