This bill establishes the "Born-Alive Abortion Survivors Protection Act," which requires healthcare providers to provide the same level of medical care to an infant born alive during or after an abortion attempt as they would to any other newborn. The bill mandates that healthcare providers must exercise professional skill to preserve the life and health of such an infant, including determining whether to initiate resuscitation, continue treatment, or provide comfort care. It creates civil liability for individuals who knowingly cause the death of a born-alive infant, fail to comply with the required medical care, perform an unlawful abortion, or aid in a self-induced abortion. The bill allows for personal injury or wrongful death lawsuits by the spouse, partner, parents, or children of the deceased, with potential damages including loss of future fertility, loss of companionship, and attorney's fees. Importantly, the bill prevents defendants from using consent or assumption of risk as a defense and prohibits individuals who engaged in criminal conduct or domestic violence that caused the pregnancy from maintaining a lawsuit or receiving damages.
