This bill modifies the collection and use of a special wheel or privilege tax in Fayette County, Tennessee. Currently collected by the county court clerk, the bill transfers the collection responsibility to the county clerk, who will collect the tax when issuing state vehicle licenses. The county clerk will receive a $1 fee for each license issued and can provide a replacement decal for an additional $1 fee if a vehicle is sold, traded, or changed. Unlike previous provisions that used the tax revenue to pay down school construction debt, the bill now requires 100% of the collected tax (excluding the clerk's fees) to be initially placed in the county general fund. The county can then use these funds for general fund purposes, transfer them to the county capital projects fund to pay for school construction or county facilities, or transfer them to the county debt service fund to pay principal and interest on debt related to school construction and county facilities. The decision on fund allocation will be made during the county's annual budget process. The bill requires approval by a two-thirds vote of the Fayette County legislative body and will become effective upon such approval.
