This bill proposes new regulations for firearm sales at gun shows in Texas, defining a gun show as an event with three or more individuals displaying firearms where an admission or display fee is charged. The bill introduces two new criminal offenses: one for individual sellers and another for gun show promoters. For individual sellers, it becomes a Class A misdemeanor to sell a firearm at a gun show without conducting a background check through the National Instant Criminal Background Check System (NICS) or without maintaining a record of the sale. Gun show promoters are required to provide advance notice to local law enforcement, ensure background checks are conducted for firearm sales, prominently display notice of background check requirements, and can be charged with a Class A misdemeanor for failing to meet these obligations. Exceptions to the background check requirement are made for sales to peace officers and individuals licensed to carry a handgun. The new regulations will take effect on September 1, 2025, with the notification requirement for gun show promoters specifically applying to gun shows held on or after October 1, 2025.
