This bill requires cities, towns, and villages in New York State to permit the construction of residential housing at a minimum density of 25 dwelling units per acre on any land within one-half mile of specific transportation facilities. A "covered transportation center" includes rail stations operated by New Jersey Transit, Metropolitan Transportation Authority, Metro-North Railroad, Port Authority of New York and New Jersey, and Long Island Rail Road, as well as bus stops with designated parking, located between one-half mile and sixty miles from a city with over one million people. The bill prohibits local governments from imposing restrictions that would effectively prevent such development, such as limitations on height, setbacks, floor area ratios, or parking. Municipalities must adjust their zoning regulations, comprehensive plans, and other land use tools to comply with these requirements. If a local government fails to act on or improperly denies an application for such housing, an aggrieved party may file a legal proceeding to compel compliance. The bill includes protections for historical sites and does not override environmental or fire prevention regulations, and it will take effect one year after becoming law.
