This bill amends Kentucky Revised Statutes (KRS) 508.025 to expand the definition of assault in the third degree by adding justices and judges of the Court of Justice to the list of people who are specifically protected from intentional or reckless physical injury. The existing law already provides enhanced protection for various professionals such as peace officers, detention facility employees, healthcare providers, social workers, emergency medical personnel, firefighters, probation officers, school employees, and others. Under the current law, intentionally or recklessly causing physical injury to these individuals using a deadly weapon or dangerous instrument can result in a Class D felony, which may be elevated to a Class C felony if the assault occurs during a declared emergency. By adding justices and judges to this list, the bill aims to provide additional legal protection for members of the judicial system, recognizing the critical role they play in maintaining law and order and the potential risks they face in the course of their professional duties.
