Bill Summary

AN ACT To amend Titles 40, 42, and 43 of the Official Code of Georgia Annotated, relating to motor vehicles and traffic, penal institutions, and professions and businesses, respectively, so as to provide for intelligent speed assistance device limited driving permits for certain suspensions of driver's licenses upon conviction for reckless stunt driving; to provide for procedures, conditions, and fees for the issuance of such permits; to provide for revocation of such permit; to provide for hearings; to provide for electronic delivery of notices and communications; to provide for the purchase or lease of intelligent speed assistance devices by counties, municipalities, or private entities; to provide for certification of intelligent speed assistance devices; to provide for warning labels; to provide for revocation of probation; to revise a short title; to provide for licenses to operate provider centers for those that install, maintain, and monitor intelligent speed assistance devices; to provide for definitions; to provide for rules and regulations; to provide an effective date; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill introduces "intelligent speed assistance devices" (ISADs), which are certified devices installed in vehicles to monitor and prevent drivers from exceeding a set speed, and "provider centers," which are facilities that install and maintain these devices. For individuals convicted of reckless stunt driving, a second offense within five years will now allow them to apply for a limited driving permit equipped with an ISAD, instead of facing a full three-year license suspension without any driving privileges. This permit, valid for one year and renewable, requires the installation of a certified ISAD and comes with specific eligibility criteria, including being at least 21 years old and not holding a commercial driver's license. The bill also outlines procedures for the revocation of these permits if the driver violates traffic laws, tampers with the device, or fails to report for monitoring, and establishes a licensing system for provider centers, including requirements for insurance, bonding, and background checks for those operating them, while also defining what constitutes a misdemeanor for tampering with or misusing an ISAD.
