AI Summary
This bill provides a tax credit for convenience stores and skilled nursing facilities that purchase and install emergency power generators between July 1, 2025, and December 31, 2026, in response to the impact of Hurricane Helene and to improve the state's preparedness for future weather events. The tax credit is limited to $5,000 per year for a maximum of five years, with a total aggregate cap of $5 million, and can only be claimed once per convenience store or skilled nursing facility, up to five stores per taxpayer. A convenience store is defined as a retail establishment under 10,000 square feet selling packaged food, fuel, and household items, while an emergency power generator includes the generator itself, transfer switches, and associated power lines and fuel tanks. To claim the credit, taxpayers must submit a preapproval application to the department, attach certification to their 2026 tax return, and cannot exceed their annual income tax liability. The tax credit provision will automatically expire on December 31, 2031, and the commissioner is authorized to create rules and regulations for implementing the program.
