This bill amends the Donated Food Limited Liability Act to expand and clarify protections for food donors. The bill removes the previous restriction that donations must be made specifically to charitable or religious organizations, instead allowing donations for free distribution to needy individuals more broadly. It maintains the existing principle that donors are immune from criminal or civil liability when donating food, provided they have reasonably inspected the food and found it fit for human consumption. The bill also expands the definition of acceptable donated food to include items not readily marketable due to factors like appearance, age, freshness, grade, surplus, or manufacturer-recommended date codes. Importantly, the immunity does not protect donors who are negligent, reckless, or intentionally misconduct, or who know or should know the food is tainted or harmful. The bill aims to encourage food donation by providing clear legal protections for donors while still maintaining food safety standards. The legislation takes effect immediately upon passage.
