This bill creates a new criminal offense in North Carolina related to the intentional manipulation of medical records by health care providers. Specifically, the bill establishes three distinct criminal scenarios: first, it makes it a Class H felony for a health care provider to destroy, alter, falsify, or omit information from medical records to conceal a medical error, abuse, or neglect that caused serious injury or death to a patient; second, it establishes a Class A1 misdemeanor for similar record manipulation intended to conceal other material facts related to potential legal claims; and third, it makes it a Class I felony for any health care provider or individual who offers or accepts money in exchange for altering medical records. The bill defines a health care provider as anyone licensed or credentialed under specific state statutes and defines medical records as personal information relating to an individual's physical or mental health condition, medical history, or treatment. Importantly, the bill does not eliminate civil remedies that might be available for actions covered under these criminal provisions, and it will become effective on December 1, 2025, applying to offenses committed on or after that date.
