This bill establishes comprehensive privacy protections for students' computing devices in educational settings by creating a new legal framework that restricts how schools can access and use audio, video, and location data from both institutional and personal devices. The legislation defines key terms like "institutional device" and "personal device" and sets strict limitations on when educational institutions or school districts can activate or access audio/video recording functions or track location data. Specifically, such access is only permitted in very limited circumstances, such as when a student initiates activation for educational purposes, when a judicial warrant is obtained, or when there is a suspected imminent threat to life or safety. If location data or device functions are accessed under these rare exceptions, the school must provide a detailed written explanation to the student and their parent/guardian within 72 hours. The bill also allows students who are 18 or older to exercise the same rights as their parents and provides a mechanism for civil action with potential injunctive relief, damages, and attorneys' fees if the privacy provisions are violated. The law is set to take effect on August 1, 2025, giving educational institutions time to prepare for and implement these new privacy protections.
