This bill requires the New York State Office for People with Developmental Disabilities to create and maintain a Community Residence Opportunities Waitlist (CROW), which will include names and contact information for individuals seeking placement in a community residence. The CROW will include people who require supervised living and are enrolled or eligible for the home and community-based services waiver for people with developmental disabilities. Providers of services with vacancies in supervised living facilities can review the CROW placement report to identify potential residents, and if they find an appropriate match through a person-centered planning process, they can accept that individual and receive reimbursement for residential habilitation services. The bill establishes a formal process for applying to the CROW, including a 30-day application review period and an appeals process if an individual is denied enrollment. Importantly, any individuals currently on existing waitlists will be automatically transferred to the CROW without additional action, and the bill is set to take effect on April 1, 2026.
