Bill Summary

This act would allow a landlord to remove a tenant from any housing accommodation, or attempt such removal or exclusion from possession, notwithstanding that the tenant has no written lease or that the lease or other rental agreement has expired or otherwise terminated, except upon order of a court of competent jurisdiction entered in an appropriate judicial action or proceeding in which the petitioner or plaintiff has established one of the several grounds of just cause set forth for removal or eviction. This act would take effect upon passage.

AI Summary

This bill provides comprehensive protections for residential tenants by establishing "just cause" requirements for evictions in Rhode Island. The legislation expands existing landlord-tenant law by defining specific legally valid reasons a landlord can remove a tenant, which include: nonpayment of rent (with protections against unreasonable rent increases), substantial lease violations, nuisance behavior, illegal use of the property, unreasonable denial of property access, and limited circumstances of the landlord's personal use. The bill applies to most residential housing accommodations, with exceptions for smaller owner-occupied properties and certain specific situations. Importantly, the bill prohibits tenants from waiving these protective rights through lease agreements and requires landlords to follow strict legal procedures when seeking eviction. The legislation also provides tenants with potential legal recourse if a landlord makes fraudulent claims about needing to recover possession of a property, including the ability to seek damages and attorney's fees. By establishing these "just cause" eviction standards, the bill aims to provide greater stability and protection for renters, preventing arbitrary or retaliatory evictions while still maintaining reasonable paths for legitimate property recovery by landlords.
