This bill establishes restrictions on state and local government agencies' interactions with media monitoring organizations, defining such organizations as companies that rate news sources for accuracy, bias, or adherence to journalistic standards. The legislation prohibits agencies from entering into contracts with media monitoring organizations, contracting with advertising or marketing agencies that use media monitoring services, or providing support to such organizations, with some exceptions. Agencies will be required to obtain certifications from contractors that they are not using media monitoring services when submitting bids, renewing contracts, or modifying existing agreements for marketing services. The bill broadly defines "agency" to include state and local government departments, educational institutions, and authorities, and "company" to encompass various business entities and their subsidiaries. Importantly, the bill does not prevent agencies from contracting for news aggregation services or receiving analytical information about advertisement performance. The provisions of this act will take effect on October 1, 2025, giving organizations time to adjust to the new requirements.
