This bill amends the education law to establish professional requirements for polysomnographic technology services, which involve conducting sleep studies and monitoring patients during sleep. The bill specifies that individuals providing these services must obtain authorization from the department by meeting specific educational and professional standards. These standards include: (1) completing an associate's degree or higher in polysomnographic technology from either a state-registered program or an equivalent program like ASTEP, STAR, or CAAHEP; (2) being a registered polysomnographic technologist in good standing; (3) being a registered respiratory therapist in good standing with the national board of respiratory care; or (4) being a certified respiratory therapist in good standing with the national board of respiratory care. Individuals must apply for authorization with a $300 fee and re-register every three years, also paying a $300 registration fee. The authorization will be subject to full disciplinary and regulatory oversight by the board of regents and the department, similar to a professional license. The bill will take effect 120 days after becoming law, with provisions allowing for immediate preparation of necessary regulations.
