Bill Summary
AN ACT to amend the mental hygiene law, in relation to reimbursement of certain programs and services for persons with a disability
AI Summary
This bill amends the New York mental hygiene law to establish a new reimbursement process for local service providers who support individuals with disabilities. Under the proposed legislation, if a person enters a program or receives a service from a local provider under section 13.15 of the mental hygiene law, and then transitions to a different program or service that is not yet approved by the commissioner, the local service provider can be retroactively reimbursed if the commissioner ultimately grants approval. The reimbursement will be processed as if the service was approved before the person's admission or receipt of the service. If the service is not approved and reimbursement has already occurred, the service provider must return the funds to the office for people with developmental disabilities within 60 days of being notified of the denial. Importantly, this provision applies retroactively to services rendered up to one year before the law's effective date, providing financial protection and flexibility for local service providers supporting individuals with disabilities.
