This bill, known as the "Fallen Tree Act," addresses property owner liability for trees and shrubs that cause damage to neighboring properties. The legislation recognizes that Florida's population growth has led to dense residential areas with trees and shrubs growing close to property lines, often creating potential hazards. Currently, under the "Massachusetts Rule," property owners can only remove branches or roots that cross their property line, but are not liable for damage caused by trees on their land. The bill changes this by making property owners responsible for damages caused by trees or shrubs rooted on their land when they fall onto neighboring properties. The law allows property owners to use self-help to remove branches or roots crossing their property line and permits removal of trees growing across multiple parcels after providing 30 days' written notice. However, the bill excludes properties larger than 5 acres from these liability provisions. The Legislature's purpose is to protect property owners from bearing the financial burden of damage caused by neighboring trees, which can lead to increased insurance premiums or policy cancellations. The act will take effect on July 1, 2025.
