This bill amends Kentucky Revised Statutes (KRS) 500.120 to expand the types of entities from which administrative subpoenas can be obtained during criminal investigations. Specifically, the bill adds social networking companies, mobile payment services, and cloud storage services to the list of potential account holders that can be compelled to provide certain records during investigations involving crimes such as child exploitation, stalking, and domestic violence. The bill allows the Attorney General or the Commissioner of the Kentucky State Police to issue subpoenas requiring these service providers to produce identifying information like electronic mail addresses, internet usernames, IP addresses, account holder names, billing addresses, and account status. However, the bill maintains restrictions on disclosing certain sensitive information like in-transit electronic communications, account passwords, and detailed account content, which can only be obtained through a warrant. The legislation also preserves existing provisions that require subpoenaed information to remain confidential and only be used in connection with related criminal cases. The bill includes procedural safeguards, such as allowing the subpoenaed party to petition to modify or set aside the subpoena, and mandating that unused records be destroyed or returned within a reasonable time.
