This bill requires manufacturers and dealers of liquid nicotine products (defined as nicotine-based liquids used in electronic cigarettes) to establish a recycling program for these products. Manufacturers must submit a recycling plan to the Department of Environmental Conservation detailing how they will safely collect and recycle liquid nicotine products, provide annual reports on recycling efforts, and educate consumers about proper recycling methods. The bill also creates a new criminal offense of "improper disposal of a liquid nicotine product," which means disposing of these products in any way other than returning them to a dealer for recycling. Violators of the recycling requirements can be fined up to $500 per violation, while individuals improperly disposing of liquid nicotine products can be fined up to $250 for a first offense and $500 for subsequent offenses, and may also be required to perform up to eight hours of community service. The bill will take effect gradually, with the recycling provisions becoming active 180 days after becoming law, and the criminal disposal provisions becoming active one year after becoming law.
