Bill Summary

AN ACT To amend Article 3 of Chapter 11 of Title 9 of the Official Code of Georgia Annotated, relating to pleadings and motions, so as to authorize movants to file notices of uncontested motions in superior courts and state courts; to provide for uncontested motions to be deemed granted and entered; to provide for review by chief judge of any judge with two uncontested motions deemed granted on his or her docket; to provide for management reports regarding each such review; to provide for statutory construction; to require that parties to a case provide a copy of filed motions or notices to the judge assigned to such case; to provide for instructions on how to provide such copies; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill modifies Georgia's legal procedures by introducing new rules for handling uncontested motions in superior and state courts. Specifically, if a judge does not rule on a properly served pretrial motion within 60 days and no party has filed an objection, the moving party can file a notice of an uncontested motion. If the judge still fails to rule within seven days of this notice, the motion is automatically considered granted and entered. The bill includes a provision that pauses this automatic process during scheduled hearings. Additionally, if a judge has two or more motions deemed granted and entered within two years, the court's chief judge may review that judge's docket management techniques and issue a report. The bill also requires parties filing motions to provide a copy to the assigned judge, with each judge responsible for establishing clear instructions on how these copies should be submitted. This legislation aims to improve court efficiency and ensure timely processing of legal motions by creating a structured mechanism for addressing unresolved court documents.
