This bill modifies the existing tuition and fee exemption for students who were previously under the conservatorship of the Department of Family and Protective Services (DFPS) by removing time-based restrictions on when a student was in conservatorship. Specifically, the bill eliminates the previous language that limited exemptions for students adopted or placed in permanent managing conservatorship only after September 1, 2009. Now, students who were under DFPS conservatorship on the day before their 18th birthday, during their high school graduation, on or after their 14th birthday if eligible for adoption, on the day before being adopted, or during an academic term with dual credit enrollment can qualify for tuition and fee exemptions at public higher education institutions. The exemption applies to undergraduate students or dual credit course enrollees who enroll in an institution of higher education before their 25th birthday. The changes will take effect for the 2025 fall semester, and the bill becomes effective immediately if it receives a two-thirds vote in the Texas legislature, or on September 1, 2025, if it does not receive the immediate effect vote.
