This bill establishes a new criminal offense called "harassment of an employee by an incarcerated individual," which is classified as a class B misdemeanor. The law specifically defines three types of harassing behaviors that an incarcerated individual or juvenile detainee could commit: (1) displaying or touching their intimate parts while in clear view of an employee, (2) intentionally positioning themselves so an employee will see them displaying or touching their intimate parts, or (3) threatening to expose an employee to their bodily fluids (blood, urine, seminal fluid, or feces) in the future. The harassment must be done with the intent to degrade, abuse, or gratify the incarcerated individual's sexual desire. The bill applies to employees of correctional facilities, hospitals, the board of parole, mental health offices, probation departments, and police officers. Additionally, the bill amends the correction law to prevent individuals convicted of this new harassment offense from participating in work release or community service programs. The law will take effect 30 days after it becomes law, with specific provisions about how the amendment to the correction law will be implemented.
