This bill expands Kentucky's medicinal cannabis program by adding several significant provisions. The bill broadens the list of qualifying medical conditions for obtaining a medicinal cannabis card, now including conditions like AIDS, Crohn's disease, fibromyalgia, and several others. Importantly, the bill permits registered qualified patients who are at least 18 years old to cultivate up to three mature cannabis plants and three seedlings on their own private property, without needing to register or notify the state. The bill also allows patients to possess raw plant material and cannabis products resulting from at-home cultivation, exempting these home-grown products from commercial potency limits. Additionally, the bill modifies existing regulations to permit smoking of medicinal cannabis on private property owned by the patient, removes the requirement that raw plant material be labeled as "not intended for consumption by smoking," and eliminates the need to keep home-cultivated cannabis in the original dispensary container. The bill maintains strict prohibitions on selling or transferring home-cultivated cannabis to others and continues to restrict cannabis use in public spaces, while schools, correctional facilities, and federal properties remain off-limits for cannabis use.
