This bill proposes to amend Vermont's emergency powers statute to give the Governor additional authority during a declared state of emergency to authorize the Agency of Natural Resources to waive certain water quality permits and restrictions for dams. Specifically, the Governor can now permit dam operators to lower water levels in advance of a flood event that is likely to cause significant damage or injury to people or property. The waiver can only be issued if the Governor, in consultation with the Secretary of Natural Resources, has substantial reason to believe that drawing down dam water levels will reduce potential damage risks. Dam operators granted such a waiver must make every reasonable effort to minimize environmental impacts from the water level reduction. The bill takes effect immediately upon passage, providing a proactive tool for emergency flood management that allows for quick action to protect public safety while requiring operators to be mindful of potential ecological consequences.
