This bill introduces the Social Media Content Transparency Act, which requires social media platforms to attach and retain "provenance data" for photos, videos, and audio files both created on their platforms and posted to their platforms. Provenance data is defined as metadata that can identify a file's origin date and place, generation method (including whether artificial intelligence was used), and transmission history. The bill specifically mandates that platforms must clearly indicate if content was created or modified using generative artificial intelligence (AI), including the name of the AI tool and its provider. Platforms must ensure this provenance data is attached in a standardized industry-accepted format and provide users with an easy method to access this information. Importantly, platforms are not required to independently verify the accuracy of provenance data provided by third parties and cannot be held liable for inaccurate information if they have acted in good faith and implemented reasonable compliance measures. The law includes an exemption for platforms that can demonstrate they lack the current technological capacity to comply but are actively working to develop such capabilities. The bill is set to take effect on September 1, 2025, giving social media platforms time to prepare for these new requirements.
