This bill makes two key changes to existing District of Columbia laws. First, it amends the Clemency Board Establishment Act to allow the Clemency Board to potentially waive the standard 5-year waiting period for individuals seeking a pardon under specific conditions. These conditions include having received a waiver from the federal Office of the Pardon Attorney or the President, not currently being on probation, parole, or supervised release, and meeting additional criteria determined by the Board. The Board retains discretion to deny waiver requests even if federal waiver requirements are met. The Board can request additional information from applicants and must provide written notice of their decision. Second, the bill extends the applicability date of the Second Chance Amendment Act from March 1, 2025, to October 1, 2027. The bill is temporary in nature, set to expire 225 days after taking effect, and will require approval by the Mayor and congressional review before becoming law.
