Bill Summary
This bill provides that notwithstanding any other provision of law to the contrary, it is unlawful for any person to manufacture, distribute, prescribe, dispense, sell, or transfer generic or nongeneric abortifacient drugs in the state. A person who violates the bill is guilty of a class “C” felony. A class “C” felony is punishable by confinement for no more than 10 years and a fine of at least $1,370 but not more than $13,660. The bill shall not be construed to impose civil or criminal liability on a woman upon whom an abortion is performed or attempted in which an abortifacient drug otherwise prohibited under the bill is used. Additionally, the bill shall not be construed to prohibit the sale, use, prescription, or administration of any contraceptive agent administered prior to conception or before a pregnancy can be confirmed through conventional medical testing. The bill makes a conforming change in the Code to eliminate a reference to an abortifacient drug prohibited under the bill.
