The bill allows a spouse, relative, friend, or guardian to petition the Circuit Court to order treatment if the individual suffers from a substance use disorder, presents an imminent danger to themselves or others, and could benefit from treatment. The petition must include detailed information about the respondent and be accompanied by a cost guarantee from the petitioner. The court will review the petition, potentially set a hearing within 14 days, and require an examination by two qualified health professionals. If the court finds proof beyond a reasonable doubt that treatment is necessary, it can order involuntary treatment for either 60 or 360 consecutive days. The bill also provides for a 72-hour emergency hospitalization option when an imminent threat is identified. If the respondent fails to attend examinations or comply with court orders, they may be summoned or transported to a hospital by the sheriff, with transportation costs included in the treatment expenses.
