This bill establishes new privacy and safety regulations for certain covered entities in Idaho, including correctional facilities, domestic violence shelters, juvenile correctional centers, and state educational institutions. The legislation requires that multi-occupancy restrooms, changing rooms, and sleeping quarters be exclusively designated for either females or males, and prohibits individuals from using facilities not corresponding to their biological sex. The bill provides specific exceptions for situations involving maintenance, medical assistance, law enforcement, emergencies, and specific forms of aid or accompaniment. State educational institutions must offer reasonable accommodations for individuals uncomfortable using sex-designated facilities, though these accommodations cannot include accessing opposite-sex facilities while others are present. The law also creates a private right of action for individuals who encounter opposite-sex persons in sex-designated facilities or are required to share sleeping quarters with opposite-sex individuals, allowing them to seek declaratory and injunctive relief within two years of a violation. The bill will go into effect on July 1, 2025, and includes a severability clause ensuring that if any part of the law is found invalid, the remaining provisions will still stand.
