AN ACT to amend the executive law, in relation to the discharging of certain sentences

This bill modifies the Executive Law to expand the conditions under which the board of parole can grant an absolute discharge to individuals on community supervision. Previously, certain felonies were excluded from eligibility, but the bill removes those restrictions, allowing the board to grant a discharge for all felony sentences. To be eligible, an individual must have been on unrevoked community supervision (such as parole or post-release supervision) for at least three consecutive years. The board can grant the discharge if it determines that doing so is in the best interests of society. Additionally, the individual must have made a good faith effort to pay any court-ordered restitution, mandatory surcharges, sex offender registration fees, or DNA databank fees if they are financially able to do so. When granted, the discharge terminates the original sentence, effectively ending the individual's supervision. The bill would take effect immediately upon passage.
