Bill Summary

AN ACT To amend Article 2 of Chapter 5 of Title 16 of the Official Code of Georgia Annotated, relating to assault and battery, so as to provide for protections for code enforcement officials; to provide for a definition; to provide for enhanced penalties for simple assault, aggravated assault, simple battery, battery, and aggravated battery committed upon code enforcement officials in certain circumstances; to provide for related matters; to provide for an effective date and applicability; to repeal conflicting laws; and for other purposes.

AI Summary

This bill amends Georgia law to provide enhanced protections for code enforcement officials, defining them as individuals employed by or contracted with local governments who conduct safety inspections of buildings, businesses, or property to ensure compliance with laws, provided they have a high school diploma or equivalent and have completed Level 1 code enforcement training. The bill increases penalties for crimes committed against these officials while they are performing their official duties, making simple assault, simple battery, and battery against a code enforcement official a high and aggravated misdemeanor, and aggravated assault and aggravated battery against them punishable by imprisonment for three to twenty years, similar to protections already in place for utility workers. These enhanced penalties will take effect on July 1, 2026, and apply to offenses committed on or after that date.
