This bill modifies existing law, known as the Mobilehome Residency Law, which governs tenancies in mobilehome parks, to provide stronger rent protections for residents. Specifically, it changes the conditions under which a mobilehome space can be exempted from local rent control ordinances. Previously, a space was exempt if the homeowner wasn't using it as their principal residence and hadn't rented it out. This bill now exempts a space only if it's not being used as "permanent housing" by the homeowner or an approved tenant, with "permanent housing" defined as a residence intended for indefinite or enduring occupancy, excluding seasonal or short-term rentals. If management believes a space is not being used as permanent housing and intends to modify rent or tenancy terms, they must now provide the homeowner with a written explanation of their determination and supporting documents. The homeowner then has 90 days to respond, and management cannot make changes until after this period and after responding to the homeowner's information. Crucially, management is prohibited from modifying terms if the homeowner provides a statement refuting the claim that the space isn't permanent housing, creating a "rebuttable presumption" in favor of the homeowner's statement, meaning management must prove otherwise. Exemptions to these protections are limited to mobilehomes actively held for sale, when the legal owner has taken possession, or if park rules prohibit subletting.
