This bill requires local agencies that maintain an internet website to post detailed information about construction contract payments within 10 days of making a payment. Specifically, the agency must publicly disclose the project name, the construction contractor or company paid, the payment date, the payment application number or other identifying information, and the total payment amount. The bill exempts construction contracts valued below $25,000 from these transparency requirements. As an important enforcement mechanism, the bill prohibits a local agency from withholding any retention proceeds from future payments if the agency fails to comply with these internet posting requirements. If the Commission on State Mandates determines that implementing these new transparency rules creates additional costs for local agencies, the state will be required to reimburse those agencies for their expenses. This legislation aims to increase public visibility into how local government funds are spent on construction projects by mandating online disclosure of payment details.
