Bill Summary

Under current law, a tenant must be notified in writing of any rent increase at least ninety days before the effective date of the rent increase. Additionally, the effective date of the increase shall not be sooner than the expiration date of the original rental agreement or any renewal or extension thereof. This bill provides that a landlord is not allowed to increase a tenant’s rent more than once per calendar year unless reasonably necessary for one or more of the following reasons: an increase in insurance premiums paid by the tenant to the landlord under the rental agreement, or an increase in infrastructure-related expenses of the manufactured home community or mobile home park paid by the tenant to the landlord under the rental agreement.

AI Summary

This bill modifies existing Iowa law regarding rent increases in manufactured home communities and mobile home parks by establishing additional restrictions on how often and why landlords can raise rent. Currently, tenants must receive written notice of a rent increase at least 90 days before the increase takes effect, and the increase cannot occur before the expiration of the original rental agreement. The new bill maintains these existing notification requirements while adding a crucial limitation: landlords can now only increase rent once per calendar year, with exceptions allowed for specific, demonstrable reasons. These exceptions include situations where there are verifiable increases in insurance premiums paid by the tenant to the landlord or documented increases in infrastructure-related expenses for the manufactured home community or mobile home park. By implementing these provisions, the bill aims to provide more predictability and protection for tenants in manufactured home communities by preventing frequent or arbitrary rent increases while still allowing landlords to adjust rent to cover legitimate, increased operating costs.
