This bill establishes the "New York State Teleworking Expansion Act", which requires each state agency to create a telework policy allowing employees to perform their job duties remotely to the maximum extent possible without reducing job performance. The bill defines "telework" as performing regular work functions at a location different from the agency's main office, thereby reducing or eliminating physical commuting. Each state agency must designate a "telework coordinator" to oversee the implementation of these programs. Importantly, for employees covered by a collective bargaining agreement, the telework policy must be mutually agreed upon by the agency and the employee's recognized labor organization. The term "state agency" is broadly defined to include departments, boards, bureaus, divisions, commissions, public authorities, public benefit corporations, councils, offices, and other governmental entities performing governmental or proprietary functions for the state. The act will go into effect 90 days after becoming law, giving state agencies time to develop and implement their telework policies.
