This bill prohibits municipalities from requiring land donations as a condition for approving land subdivision plans. Specifically, the bill removes existing language that previously allowed planning commissions to require developers to either provide open spaces or pay a fee equivalent to up to 10% of the land's fair market value. Under the new provisions, commissions can still require regulations about subdivision safety, infrastructure, drainage, and street design, but they cannot mandate land transfers to the municipality. The bill also clarifies that commissions can still require financial guarantees for public improvements and utilities, and can conditionally approve subdivision plans, but they cannot require developers to transfer land ownership as part of the approval process. Additionally, the bill repeals a related statute (Section 8-25b) and will take effect on July 1, 2025. The goal appears to be reducing barriers and costs for land development by preventing municipalities from requiring mandatory land donations during the subdivision approval process.
