This bill requires high resource use facilities (defined as facilities with a peak energy load of 30 megawatts or more) to submit annual disclosure reports providing detailed information about their energy and water usage, as well as community impact. Facilities must submit these reports by December 31st each year, with proposed or planned facilities required to submit reports 30 days before seeking tax incentives or governmental permits. The disclosure reports must include comprehensive details such as facility specifics, energy consumption (including sources and peak load), water usage (including sources and discharge), and community impact information like total property taxes paid, air quality permits, and noise levels. The reports must be submitted to the state department, will be published on a public website, and are not considered confidential. Importantly, facilities that fail to submit a proper disclosure report will be ineligible for tax incentives. The goal appears to be increasing transparency about the environmental and local economic effects of large energy-consuming facilities by mandating public disclosure of their resource use and community interactions.
