AI Summary
This bill enhances regulations for property owners' associations (POAs) in Georgia by introducing several key provisions. It requires POAs to provide annual certificates of good standing for lots with fully paid assessments, mandates detailed statements of account within ten business days of request, and establishes new requirements for these statements, which must include comprehensive information such as assessment details, outstanding balances, violations, and contact information. The bill also introduces a mandatory alternative dispute resolution (ADR) process that must be offered before a POA can create a lien for unpaid assessments, ensuring lot owners have a fair, no-cost method to resolve financial disputes. If a lot owner requests ADR and the association fails to participate, they cannot establish a lien for unpaid charges. Additionally, the bill clarifies liability for unpaid assessments during property transfers, stipulating that grantees can request a statement of account that can protect them from being responsible for excessive unpaid assessments beyond what is specified in the statement. These changes aim to increase transparency, fairness, and communication between property owners and associations, with the provisions set to take effect for new contracts after July 1, 2025.
